Required: New Disclaimer 1557 Must Be Posted at Formal & Informal Marketing/Sales Events

Effective immediately, the Office of Civil Rights (OCR) and Centers for Medicare & Medicaid Services (CMS) require a new disclaimer outlining non-discrimination requirements to be posted at all formal and informal marketing/sales events and other public spaces (e.g., Retail Program kiosks) where Medicare Advantage (MA) organizations and/or Part D Plan sponsors promote Medicare plans. The reason for this change is that the OCR issued new regulations to implement Section 1557 of the ACA, prohibiting discrimination on the basis of race, color, national origin, sex, age or disability in health care programs that receive federal funds.

To comply with this requirement, UnitedHealthcare will provide tabletop displays of this new disclaimer starting next week that must be displayed at any UnitedHealthcare-exclusive formal or informal marketing/sales event (e.g., community meeting / kiosk). Please note that displays and marketing materials containing this new non-discrimination disclaimer are for use with UnitedHealthcare-exclusive marketing/sales events and activities only.

If you host a formal or informal marketing/sales event scheduled prior to obtaining the tabletop materials, please display a PDF version of the disclaimer.
